Terms of Service

These Terms of Service ("Terms") govern your use of PepAI ("the App"), operated by EFN Group LLC ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Nature of the App

PepAI is an educational and informational tool for peptide research. The App provides:

• A compound encyclopedia with data sourced from published research literature
• An AI-powered research assistant that references published studies
• Personal logging and tracking tools for user-entered data
• Reconstitution calculators and research planning tools

The App does not provide medical advice, diagnoses, or treatment recommendations. Nothing in the App should be interpreted as a recommendation to use, purchase, or administer any compound. All information is presented as published research data for educational purposes only.

2. Not Medical Advice

You acknowledge and agree that:

• The App is not a medical device, healthcare service, or clinical tool.
• The App does not diagnose, treat, cure, or prevent any disease or condition.
• The App does not recommend dosages, compounds, or treatment protocols.
• Information presented in the App is derived from publicly available research literature and may not be complete, current, or applicable to your individual circumstances.
• You should always consult a qualified healthcare professional before making any decisions related to your health.

3. Eligibility

You must be at least 18 years old to use the App. By using the App, you represent and warrant that you meet this age requirement.

4. Account and Security

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized use of your account.
• We use Supabase for authentication and data storage. Your account is subject to their infrastructure and security practices.

5. Subscription and Payment

• The App requires a paid subscription after a 7-day free trial period.
• Subscription plans are billed through Apple's App Store via RevenueCat.
• Monthly Plan: $7.99/month
• Annual Plan: $64.99/year
• Free Trial: 7-day free trial. If you do not cancel before the trial ends, you will be automatically charged the subscription price.
• Payment will be charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
• You may manage your subscription and turn off auto-renewal by going to your Account Settings in the App Store after purchase.
• Refunds are handled according to Apple's refund policy. We do not process refunds directly.
• We reserve the right to change subscription pricing. Any price changes will take effect at the start of your next billing period following notice.

6. User-Generated Content

• You retain ownership of all data you enter into the App (logs, protocols, notes, chat messages).
• You are solely responsible for the accuracy of data you enter.
• By using the App, you grant us a limited license to store and process your data solely for the purpose of providing the App's functionality to you.
• We do not sell your personal data to third parties.

7. AI Assistant

• The AI research assistant is powered by third-party AI models and provides responses based on published research data.
• AI-generated responses may contain inaccuracies, omissions, or outdated information.
• AI responses are not medical advice, professional guidance, or personalized recommendations.
• You should independently verify any information provided by the AI assistant.
• We do not guarantee the accuracy, completeness, or reliability of AI-generated content.

8. Prohibited Uses

You agree not to:

• Use the App as a substitute for professional medical advice, diagnosis, or treatment.
• Distribute, resell, or commercially exploit the App's content without authorization.
• Attempt to reverse-engineer, decompile, or extract source code from the App.
• Use the App to facilitate the illegal purchase, sale, or distribution of any controlled substance.
• Submit false, misleading, or harmful content through the App.
• Attempt to circumvent the App's subscription or payment systems.

9. Intellectual Property

• The App, its design, code, content, and branding are the property of EFN Group LLC and are protected by applicable intellectual property laws.
• The compound encyclopedia data is sourced from published research literature and is presented for educational purposes.
• You may not reproduce, distribute, or create derivative works from the App's content without our written permission.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, error-free, or secure.
• The information in the App is accurate, complete, or current.
• The App will meet your specific requirements.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EFN GROUP LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR HEALTH OUTCOMES, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You expressly acknowledge that any decisions you make regarding compounds, dosages, or health practices are made entirely at your own risk and discretion.

12. Indemnification

You agree to indemnify, defend, and hold harmless EFN Group LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the App or violation of these Terms.

13. Third-Party Services

The App integrates with third-party services including Supabase, RevenueCat, and AI model providers. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices or availability of third-party services.

14. Modifications

We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or via email. Your continued use of the App after changes constitutes acceptance of the updated Terms.

15. Termination

• We may suspend or terminate your account at our discretion for violation of these Terms.
• You may delete your account at any time from the Settings screen within the App. You may also request deletion by contacting us at support@pepai.cc.
• Upon account deletion, your personal data will be permanently removed within 30 days in accordance with our Privacy Policy.
• Deleting your account does not automatically cancel your subscription. You must cancel your subscription separately through the App Store.
• Upon termination, your right to use the App ceases immediately.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.

17. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial and to participate in class action lawsuits.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
